Correct, I have no faith in the OPA being able to legally enforce the guidelines. I was of much the same opinion when I was a sitting member of the board. The ESBA lawsuit was about only one issue. Yes I have it in writing. Marty |

For reference, the above message is a reply to a message where: Yes he can and without a variance from ARC or anyone else. I seriously doubt the guidelines are enforceable. Unbelievable. A former board member saying the OPA Guidelines are not enforceable.I suppose the court case of Eastern Shore Builders versus OPA from back in the 80s (??) is meaningless, even though OPA won when the court essentially declared OPA could enforce Guidelines based on the DRs. OPA management has approved me placing more than one candidate sign as long as second or third signs are all for different candidates. Do you have a copy of that, or is yet another item created from memory? How about a look at the real thing - the DRs. g) All signs, billboards, or advertising structures of any kind are prohibited except upon application to and written permission from the Committee. |
