For reference, the above message is a reply to a message where: I agree with you (Marty). IMO guidelines are like policies they come and go with the administration in power at the time. If you are saying any currently approved Guidelines are not enforceable, perhaps we have another former board member who does not understand OPA's governing documents. John, are you aware of the court case of Eastern Shore Builders Association versus the Ocean Pines Association? More broadly, Guidelines indeed may come and go, but while Guidelines approved by the Board of Directors are in effect, they are enforceable. Any and all Guidelines must be based on authority contained in the DRs. You may not like some or all Guidelines, but until a court says otherwise, they are enforceable. If they are not enforceable, why are there many hundreds of CPI violations based on the Guidelines? |
