As referenced, Section 5c. of the proposed gives CPI inspectors the authority to enter the property for a visual inspection, as we get numerous complaints about violations in the rear of the yard that we cannot observe from the roadway. The section you are referencing (5.D.2) is for the Architectural Review Committee to enter the property for visual inspection regarding variance/exception requests only. The homeowner will be notified during the variance/exception process that the committee may be entering the yard. If they refuse, it will be noted on the application. | ||||||

For reference, the above message is a reply to a message where: OPA inspectors should not be able to trespass on anyones property without consent. A phone call or email prior to request permission should be the way to go. What happens if access is requested but refused? Resolution M-01 as proposed says: ARC shall: 2. Be able to enter onto a lot to conduct an inspection, with the purpose of entry limited to observation and/or documentation, when necessary, and after attempting to obtain the owner's permission. |
