If access is refused then there may be basis for entry with a warrant or some other legal move. But no one has the right to trespass, or enter private property uninvited. | ||||||

For reference, the above message is a reply to a message where: OPA inspectors should not be able to trespass on anyones property without consent. A phone call or email prior to request permission should be the way to go. What happens if access is requested but refused? Resolution M-01 as proposed says: ARC shall: 2. Be able to enter onto a lot to conduct an inspection, with the purpose of entry limited to observation and/or documentation, when necessary, and after attempting to obtain the owner's permission. |
