Agreed -- Aside from what is implicit, Section 14 of the DRs grants express authorization, under certain conditions, for OPA staff to enter onto an owner's property to correct non-compliance. This is further support for an inspection/entry right that exists. -BB |

For reference, the above message is a reply to a message where: Bruce: Thank you for your response. The majority of our current Declaration of Restrictions do indeed address access on to member’s property. In my Section 11, as well as most early documents, it is found at Article 14. “Associations Right to Perform Certain Maintenance“. Such action requires a 2/3 vote of the sitting board in order to be exercised. Marty |
