I asked everyone but was told there was no definitive opinion outside of the Beach Club parking issue. I DON’T BELIEVE ONE EXISTS! How does Riddle Farm do it? How does Captains Cove do it? Sea Colony? Perhaps we might want to change our status with the IRS to be private again like we were initially when I first purchased. Private roads, private golf course and Country Club, private Beach Club, private pools all doing well enough to keep our yearly due less then $250.00. Marty |

For reference, the above message is a reply to a message where: Who did you ask for this legal opinion? Maybe you should ask the Federal judge that decided the IRS case against OPA. Also, I am told The Parke is not 501(c)(4) so why do you keep making the comparison to OPA? Our pools must be open to the general public, just as the beach parking must be open for public purchase of passes. OPA lost big bucks fighting the IRS over the very issue of amenities being open to the general public. Every avenue was exhausted shy of the United States Supreme Cout. OPA lost. That is why today a member of the general public can buy a parking pass. |
