For reference, the above message is a reply to a message where: If OPA were to force homeowners like me to remove their naturally mulched leaves or pine needles in favor of a store-bought alternative, it would fundamentally contradict both the spirit and the letter of the law. This requirement would effectively restrict an ecologically beneficial practice that is recognized as low-impact landscaping. House Bill 322 clearly states that as long as a homeowner is keeping their landscaping properly maintained, the decision to use natural method (such as leaving mulched leaves) should not be unduly limited by HOA rules. Moreover, if OPA would insist that a homeowner like me should remove their beneficial mulched leaves and then replace it with a store-bought mulch instead of the natural mulch that would substantially increase landscaping expenses, a burden that HB322 is specifically designed to avoid when preventing unreasonable limitations on low-impact practices. |
