The Montgomery Co. police says they do not know of a Maryland law or Mo.Co. law that prohibits golf carts in private communities. And they are probably correct, but OPA's roads are not private. Nancy, OPA roads are now public accessible roads under Maryland law. I realize this is a difficult concept for some to understand, however back in 1988 OPA relinquished its right of having private roads when it signed a contract with Worcester County to turn over the OPA roads to the county as a public easement.... in return for a cut of state highway funds. The roads in OPA are open to the public. They are not private roads. While OPA still owns the property covered by the roads, it has granted a public easement to the county. BTW, I just read the agreement today. It allows the county or OPA to cancel at any time. Please read the below carefully: Any vehicle that is not registered in the state of Maryland may not be driven on Maryland highways. Maryland vehicle law defines highways as the entire width between the boundary lines of any way or thoroughfare of which any part is used by the public for vehicular travel, whether or not the way or thoroughfare has been dedicated to the public and accepted by any proper authority. This means ATVs, motorized skate boards, motorized bicycles, motorized mini-bikes, go-carts and golf carts can only be driven on private property with the permission of the owner or agent. |

For reference, the above message is a reply to a message where: Actually the roads in Ocean Pines are owned by Ocean Pines Association, Inc. Marty But are subject to Maryland and County laws. Joe, Residents have been driving golf carts at Leisure World since 1967. They still do. The community is gated and no one may drive outside the gates. People do try to sneak up to the Giant shopping center which is a right turn inton the lot just outside the gate, but they are stopped if the guard sees them. If a golf cart is going less than the speed limit, they must keep to the right of the road, so that folks can pass easily. These carts are not registered. Ocean Pines even has its own police dept. ...since there is no county police dept. Maybe the laws in Worcester Co. are different from the rest of the state. There is no STATE law that prohibits drivining a golf cart on private roads.( if there were, I think that they would have found out about the carts at Leisure World ... by now. ) Golf carts are very convenient, and they do hold down the speeding, save money and take up less space in parking lots. They work well....and are especially important now with horrible gas prices. Nancy
