Downgrading of an existing zoning is tough in court. Very tough. When those properties are auctioned the price will be based on the current zoning. |

For reference, the above message is a reply to a message where: There are two parcels being auctioned - correct? The northern one is entirely wetlands (88 ac), that borders St.Martins neck and Lighthouse Sound. As far a rezoning, that's why we have comprehensive rezoning process. If downzoining is done, the pain is shared and it is not a partial process . If it is done fairly, the courts should support the County. The issue may be moot, if the actual recommended zoning with the new compl planis not followed up with a rezoning of the property. |
