The clear language is "on the lot" which none of the right of way adjacent to my lot is. I take care of the easement on my lot as required by the DRs. 10 feet front and back and 5' on each side of my property (lot). The DRs say nothing about the lot owner having to take care of the OPA owned right of way outside of the boundaries of the lot.
The DRs do say that the lot owner is responsible for easements, drainage ditches , etc. on their lot. I am doing that as I stated above. Nowhere in the DRs does it say that I am responsible for OPA owned property only what is on my lot. |

For reference, the above message is a reply to a message where: So now you agree with me that the roadway is 50’ wide on most side street Never said otherwise. 50 foot right-of-way. Lot owners are not responsible to maintain the right of way because it is not on their lot So you claim. The declarations of restrictions say otherwise. Call your lawyer. and have him read the plain English language in DRs you agreed to follow. Or do you want me to post it here yet again? |
