I suspect that a court would conclude that "For each lot" would have the same as "On each lot" in section 10.D. of the DRs.

That said, I think there is a lack of clarity in the DRs and OPA leadership would do the community a favor by sharing their legal review of this question of responsibility for the drainage ditches in the front of most OPA lots. This legal review could look at the following:

• Explain the meaning of DR section 12.C. which says in part, "The Association shall be responsible for the appurtenant drainage and slope easements reserved by the Declarant." (the Association).  How does this not conflict with 10.D.?
• I for one would like to see a declarative legal statement that the thousands of individuals who bought OP property since 1968 agreed to maintain property owned by OP, i.e. that 15-foot strip, give or take, from the owners front lot line to the road.
• OPA relies on section 14.A. of the DRs for authority to resolve a citation and charge the lot owner for it. But section 14.A. ties poorly to 10.D.  Where 10.D. uses "rights-of-ways and easements reserved by OPA" you won't find those words in 14.A.; rather 14.A. talks about the lot, i.e. within lot boundaries owned by the lot owner.  Section 14.A. does include the word "premises."  Is premises supposed to include the right-of-way from the road edge toward the lot owner's property line that is owned by OP?
• How does legal counsel view OPA's practice of mowing the grass from the road edge toward the drainage ditch? This notion of "if it falls from the sky it's the owner's responsibility but if it grows up from the ground it's OPA's" is nonsense - nowhere found in the DRs.  Does OPA undercut it position of citing lot owners for not raking leaves in the right-of-way from road edge to property line when it mows some or all of this same area?
• Legal Counsel should review resolution M-04 Maintenance of Lots.  It makes no mention of rights-of-way and easements reserved by OP, the linchpin of DR section 10.D.  It only mentions property owned by members.

We could use clarity on this question just as much if not more as the question of parking on OP roads.
