Harry, a couple thoughts.
I suspect that a court would conclude that "For each lot" would have the same as "On each lot" in section 10.D. of the DRs. That said, I think there is a lack of clarity in the DRs and OPA leadership would do the community a favor by sharing their legal review of this question of responsibility for the drainage ditches in the front of most OPA lots. This legal review could look at the following:
We could use clarity on this question just as much if not more as the question of parking on OP roads. |

For reference, the above message is a reply to a message where: The clear language is "on the lot" which none of the right of way adjacent to my lot is. I take care of the easement on my lot as required by the DRs. 10 feet front and back and 5' on each side of my property (lot). The DRs say nothing about the lot owner having to take care of the OPA owned right of way outside of the boundaries of the lot. The DRs do say that the lot owner is responsible for easements, drainage ditches , etc. on their lot. I am doing that as I stated above. Nowhere in the DRs does it say that I am responsible for OPA owned property only what is on my lot. |
