The plain English in the DR’s that we agreed to follow also state that “No outside burning of wood….shall be permitted” . Unless of course it is as determined by any given board.
Well, not just the board has the right to seek DR enforcement. Every association member also has the right to seek enforcement in court if my interpretation of the DR below is correct: 18. Remedies A. The Association or any party to whose benefit these Restrictions inure, including the Declarant, its successors and assigns, may proceed at law or in equity to prevent the occurrence, continuation or violation of any of these Restrictions; provided, however, that it in expressly understood that neither Declarant nor the Association shall be liable for damages of any kind to any party for failing to either abide by, enforce, or carry out any of these Restrictions. |
