I lived in a condominium and we successfully sued the management company and the board, but, we were lucky to live in Metro DC with less of an old boy/girl network. I don’t think you can find an attorney in this area with the interest or expertise to handle this type of legal action, which is another reason the AG created this office. Many homeowners statewide don’t have access to a private attorney with this type of expertise but that doesn’t mean they give up their rights and protections as a homeowner in an HOA in MD.

I urge everyone to read the 40 or so easy to read pages of the HOA law 11/1/2022 to find out how far away from that law Ocean Pines board and management is going. A document was created granting board and management almost unlimited power over homeowners. This document attempts to fast track DR changes without the pesky vote by homeowners, so without knowledge of homeowners, new rules were created which were enforced without notice and DR changes are being made without a vote by section of the homeowner. There is no appeal process as required for homeowners. At some point homeowners need to stand up and demand their legal rights under MD HOA Law. The only entity with the power to enforce the law and give homeowners their rights under the declaration of restrictions is the office of attorney general.
