It is 50% + 1. .5(503) = 251.5 +1 = 252.5 = 253 votes required for 50% +1 However, 252 is a majority of the lots in the Parke not 253: 252+251 = 503 lots 50% + 1 is not a majority in the DR vote context It is in sections with an even number of lots, provided the are no overriding factors as in the Parke. Talk about splitting hairs over sections with an odd number of lots. Obviously, there can be no half-lot vote. And for formal purposes, each section must be examined individually. But thank you for the odd-lots math and keeping us on our toes. Amending our (OPA) DR is by approval of a majority of all lot owners in OPA plus a writing signed by the Board (OPA). The likelihood of change is nil. What is a writing signed by the board? |
