If we incorporate any future restrictions based on "class" they will, in my opinion, also be overturned. If you refer to 'class' as in the social pecking order it is definitely a no-no...but class as perhaps in weight class for the trailer (for instance - one ton) could be valid. The current rules are...in my non-expert opinion...lacking in both reasoning and description for prohibition (at least in the DRs) of certain vehicles. By contrast the Guidelines are pretty specific on the maximum size of open utility trailers that are allowed. Following this same format OPA might find its way to create an acceptable and easily understood 'rule.' Even if someone disagrees...if the rule is clear there is no recourse except to follow it or suffer the consequences...because there is no 'wiggle room' based on interpretation. BTW, this is not about Marty. Understood...but it is kind of about Marty doing things in his own, sometimes frustrating but always loveable way. |

For reference, the above message is a reply to a message where: Bob: "Nothing says that if Marty wins, OPA cannot revisit the issue and perhaps create a clearer definition of what it wants to allow or prohibit" Correct, if the change to our documents meets the "legal" test.
